Key legal considerations
How we approach your case
As family law professionals, we at the HGW Family Department, across all offices (Wimborne, Broadstone, Christchurch & Verwood), regularly consult clients facing divorce and those tricky negotiations, often outside court, that need to be navigated with our help, to ensure that financial needs are met as far as possible, and fairness prevails.
That is the aim.
Your circumstances
We turn to our knowledge of the law to apply it to your individual circumstances. You will appreciate that all family dynamics differ, therefore discretion in applying the law to your own circumstances is key, to achieve that need and overall fairness as much as is possible.
Needs
In some cases, there are not enough assets to meet the needs of the couple concerned at all. Those are the most difficult, and we have to gauge those circumstances based on the facts of your case, where, unfortunately, neither of you may emerge satisfied, or one of you need the assets more than the other where, for example, caring for children is the primary consideration.
In others, there are circumstances where assets exceed the needs of the parties, and fair sharing of the remainder becomes an issue between couples.
Financial disclosure and negotiation
Once full financial disclosure of each of you is exchanged, and questions raised and answered of the evidence displayed by each of you, key legal principles are then considered by legal professionals to evaluate the overall global assets of the marriage, and then seek to negotiate for each of you, outside the court arena hopefully.
The trouble with court proceedings of course, is that there is an inevitable delay and a much more expensive process which does not assist an already stressful period in your life, only to (potentially), find yourself at a final hearing in front of a stranger who will decide your future for you both (the judge). Not ideal.
The next article concentrates a little more on the specifics of what we are talking about in this article and can be found next to this on the website.
