Contested Probate or a Disputed Will is a dispute involving inheritance or the validity of a Will. Following the death of a loved one, disputes can arise over some of the provisions made within the Will. This can involve disagreements over a person’s entitlement to be a beneficiary under a Will, particularly where there are questions over the deceased’s testamentary capacity, or where undue influence may have been exercised over them by a relative. It can also occur when for example a family member, cohabitee or dependant believes that the deceased has not made proper provision for them.
A sensitive approach is required when dealing with issues around entitlement in a Will.
